1. Scope of this policy

This Privacy Policy applies to the PineCloud Labs website at pinecloudlabs.com, general business communications with PineCloud Labs LLC (“PineCloud Labs,” “we,” “us,” or “our”), and information we handle while evaluating or providing custom software development services.

Our products have their own privacy notices because they handle different information. Those product-specific notices control for information collected through the applicable product:

A client agreement, data processing agreement, or other written contract may also govern information we handle for a custom software client. If a contract conflicts with this policy, the contract controls for that client relationship.

2. Information we collect

Information you provide

If you use our contact form, Formspree processes your name, email address, message, and related technical information and delivers the submission to us. Formspree may also collect information such as your IP address, browser type, access time, and referring page to operate and secure its service. You can learn more in Formspree’s Privacy Policy. If you contact us another way or discuss a potential project, we may also receive your phone number, company name, job title, and other information you choose to provide. If we work together, we may receive billing details, contracts, project requirements, files, credentials, technical records, and other information you or your organization provides.

Information collected when you visit the website

Our hosting, security, and form-processing providers may automatically process basic technical information needed to deliver and protect the site, such as your IP address, browser and device type, requested pages, referring page, and the date and time of a request. PineCloud Labs does not currently use account registration, advertising technology, or first-party analytics on this website.

This website loads design resources from Google Fonts and the Tailwind CSS content delivery network. When your browser requests those resources, the providers may receive technical information such as your IP address and browser details under their own privacy terms.

Information handled for clients

When providing custom development services, we may process information supplied by a business client or generated while performing the work. The types of information and our role depend on the project. Where we process personal information on a client’s behalf, the client determines the purpose of that processing and we handle the information according to the client’s instructions and our agreement.

3. How we use information

We use information described in this policy to:

• respond to questions and communicate with you;
• evaluate, plan, provide, support, and improve software products and services;
• prepare proposals, contracts, invoices, and other business records;
• operate, maintain, troubleshoot, and protect our website and systems;
• prevent fraud, misuse, security incidents, and other harmful activity; and
• comply with legal obligations and enforce our agreements.

4. How we share information

We do not sell personal information, and we do not share personal information for cross-context behavioral or targeted advertising. We may disclose information in the following limited circumstances:

• Service providers. Formspree accepts, processes, stores, and delivers website contact-form submissions for us. Other vendors that help us provide hosting, email, cloud storage, security, payment, accounting, and business operations may also process information for us.
• Client-directed work. We may disclose information as instructed or authorized by a custom software client and consistent with our agreement.
• Legal and safety needs. We may disclose information when reasonably necessary to comply with law, respond to valid legal process, protect rights or safety, or investigate fraud or security issues.
• Professional advisers. We may share relevant information with lawyers, accountants, insurers, and other advisers subject to appropriate confidentiality duties.
• Business changes. Information may be transferred as part of a merger, financing, acquisition, reorganization, sale of assets, or similar business transaction.
• With your direction or consent. We may share information when you ask us to or otherwise authorize it.

Mobile information and SMS consent

We do not sell, rent, transfer, share, or disclose mobile phone numbers, SMS opt-in data, or SMS consent to third parties or affiliates for marketing or promotional purposes. SMS opt-in data and consent are not shared with any external organization for any purpose, including with user consent, except as required by law. This exclusion applies to every category described above.

5. Retention and security

We retain information for as long as reasonably necessary for the purposes described in this policy, including to provide services, maintain business and financial records, resolve disputes, meet contractual commitments, and comply with law. Retention periods vary based on the type of information and the relationship involved. Formspree retains contact-form submissions and related information according to its own service settings and retention practices. Product-specific retention practices are described in each product’s privacy policy.

We use reasonable administrative, technical, and organizational measures designed to protect information. No storage or transmission method is completely secure, so we cannot guarantee absolute security.

6. Your choices and privacy rights

You may ask to access, correct, or delete personal information PineCloud Labs holds about you, or object to or restrict certain uses of that information. Depending on where you live, applicable law may provide additional rights. We may need to verify your identity before completing a request, and some requests may be limited by legal, security, contractual, or recordkeeping requirements.

To make a privacy request, email support@pinecloudlabs.com. For information controlled by one of our business clients, please contact that client directly; we will assist the client as required by our agreement and applicable law.

7. Children’s privacy

The PineCloud Labs website and our custom software services are not directed to children under 13, and we do not knowingly collect personal information from children under 13 through this website. If you believe a child has provided us with personal information, contact us so we can review and delete it as appropriate.

8. Third-party links

Our website may link to websites and services operated by others. Their privacy practices are governed by their own policies, and PineCloud Labs is not responsible for those practices.

9. Changes to this policy

We may update this policy as our products, services, and privacy practices change. We will post the revised version on this page and update the effective date. If a change is material, we may provide additional notice where appropriate.
